Important Notice on Entity and Scope

All physical products (e.g. seeds, natural cosmetics) sold via shop.herbwoman.eu/de are offered and invoiced by Falkasete AS, registered in Norway under NO988195154VAT, based at Skreddarstuva 141, 4160 Finnøy, Norway.

All online courses and digital learning services (e.g. e-learning platforms, course materials) are sold and managed by Salon AS, registered in Norway under NO921312660VAT, operating from the same address.

Please note that different terms apply to physical product sales and to course service agreements. For terms specific to online courses, please refer to this dedicated Course Terms and Conditions page, and for refund information, visit our Refund & Returns Policy.

This course agreement is between you, the user of this Website, and Salon AS, the owner of this Website. By using the Website for the first time you agree to comply with and be bound by Clauses 1, 2, 4 – 11 and 15 – 25 of these Terms and Conditions. Clauses 3 and 12 – 14 apply only to the sale of Services. If you do not agree to be bound by these Terms and Conditions, you should stop using the Website immediately.

No part of this Website is intended to constitute a contractual offer capable of acceptance. Your order constitutes a contractual offer, and Our acceptance of that offer is deemed to occur when We send you an order-confirmation email indicating that your order has been accepted.

Installment Payments and Interest

By enrolling in a course, you agree to pay the full course fee, even if payment is made in installments. These installments are a method of financing the full amount owed and do not represent a subscription or a pay-as-you-go model.

If you stop participating, you are still contractually obligated to pay the outstanding balance.

In case of non-payment:

  • Salon AS will issue written reminders, allowing at least 14 days for payment.
  • If payment is not received, your account access may be suspended.
  • The outstanding balance may be transferred to a licensed debt collection agency.
  • Interest will be charged in accordance with the Norwegian Act on Interest on Overdue Payments (Forsinkelsesrenteloven) at the prevailing statutory rate.
  • You may also be liable for standard debt collection fees.

Salon AS reserves the right to enforce the contract and recover unpaid amounts using legal remedies.

1. Definitions and Interpretation

In this Agreement the following terms shall have the following meanings:

  • “Account” – collectively the personal information, Payment Information and credentials used by Users to access paid Content and/or any communications System on the Website;
  • “Content” – any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Website;
  • “Facilities” – collectively any online facilities, tools, services or information that Salon AS makes available through the Website now or in the future;
  • “Services” – the services available to you through this Website, specifically the exclusive e-learning system of Salon AS;
  • “Payment Information” – any details required for the purchase of Services from this Website, including, but not limited to, credit/debit-card numbers, bank-account numbers and sort codes;
  • “Premises” – Our place of business at Skreddarstuva 141, 4160 Finnøy, Norway;
  • “System” – any online communications infrastructure that Salon AS makes available through the Website now or in the future, including, but not limited to, web-based email, message boards, live-chat facilities and email links;
  • “User” / “Users” – any third party that accesses the Website and is not employed by Salon AS and acting in the course of their employment;
  • “Website” – the website you are currently using (herb-woman.learnworlds.com) and any sub-domains of this site (e.g. subdomain.yourschool.com) unless expressly excluded by their own terms and conditions; and
  • “We/Us/Our” – Salon AS, a company registered in Norway under number NO 921 312 660 VAT whose registered address is Skreddarstuva 141, 4160 Finnøy, Norway.

2. Age Restrictions

Persons under the age of 18 should use this Website only with the supervision of an adult. Payment Information must be provided by or with the permission of an adult.

3. Business Customers

These Terms and Conditions also apply to customers buying Services in the course of business.

4. Intellectual Property

4.1 Subject to the exceptions in Clause 5 of these Terms and Conditions, all Content included on the Website, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software, is the property of Salon AS, Our affiliates or other relevant third parties. By continuing to use the Website you acknowledge that such material is protected by applicable Norwegian and international intellectual-property and other laws.

4.2 Subject to Clause 6 you may not reproduce, copy, distribute, store or in any other fashion re-use material from the Website unless otherwise indicated on the Website or unless given Our express written permission to do so.

9. Use of Communications Facilities

9.1 When using any System on the Website you must comply with the following rules. Failure to do so may result in your Account being suspended or closed:

  9.1.1 You must not use obscene or vulgar language.
  9.1.2 You must not submit Content that is unlawful or otherwise objectionable. This includes, but is not limited to, Content that is abusive, threatening, harassing, defamatory, ageist, sexist or racist.
  9.1.3 You must not submit Content that is intended to promote or incite violence.
  9.1.4 It is advised that submissions are made in Icelandic, Danish, Swedish, Norwegian or English, as We may be unable to respond to queries in other languages.

  9.1.6 You must not impersonate other people, particularly employees or representatives of Salon AS or Our affiliates.
  9.1.7 You must not use Our System for unauthorised mass-communication such as “spam” or “junk mail”.

9.2 You acknowledge that Salon AS reserves the right to monitor all communications made to Us or using Our System.

9.3 You acknowledge that Salon AS may retain copies of any and all communications made to Us or using Our System.

9.4 You acknowledge that any information you send to Us through Our System may be modified by Us in any way, and you hereby waive your moral right to be identified as the author of such information. Any limitations you wish to place on Our use of such information must be communicated to Us in advance, and We reserve the right to reject such terms and associated information. Any comments, remarks or material posted by students related to the course that are deemed inappropriate, unethical or in contravention of applicable law will be removed immediately (or as soon as discovered), and the individual in question may face further sanctions where applicable.

10. Accounts

10.1 To purchase Services on this Website and to use certain other parts of the System you must create an Account containing certain personal details and Payment Information (which may vary depending on your use of the Website). By continuing to use this Website you represent and warrant that:

  10.1.1 all information you submit is accurate and truthful;
  10.1.2 you have permission to submit Payment Information where permission may be required; and
  10.1.3 you will keep this information accurate and up-to-date. Creating an Account is further affirmation of your representation and warranty.

10.2 Do not share your Account details, particularly your username and password. We accept no liability for losses or damages incurred as a result of your Account details being shared by you. If you use a shared computer, do not save your Account details in your browser.

10.3 If you believe your Account details have been obtained by another without consent, contact Us immediately to suspend your Account and cancel any unauthorised orders or payments. Orders or payments can only be cancelled until Services provision has begun. If an unauthorised provision begins before you notify Us, you will be charged for the period from the commencement of provision until the date you notify Us.

10.4 When choosing a username you must adhere to the terms in Clause 9. Failure to do so could result in suspension and/or deletion of your Account.

11. Termination and Cancellation of Accounts

11.1 Either Salon AS or you may terminate your Account. If We terminate your Account, you will be notified by email and an explanation for the termination will be provided. Notwithstanding the foregoing, We reserve the right to terminate without giving reasons.

11.2 If We terminate your Account, any current or pending orders or payments will be cancelled and provision of Services will not commence.

12. Services, Pricing and Availability

12.1 Whilst every effort has been made to ensure that all general descriptions of Services available from Salon AS correspond to the actual Services provided, We are not responsible for variations, as the exact nature of the Services may vary according to your requirements and circumstances. This does not exclude Our liability for negligence and refers only to variations of the correct Services, not to different Services altogether (see 13.8 for incorrect Services).

12.2 Where appropriate, you may be required to select the required Service package or plan.

12.3 We neither represent nor warrant that such Services will be available at all times and cannot confirm availability until confirming your order.

12.4 All pricing information on the Website is correct at the time of going online. We reserve the right to change prices and alter or remove special offers as necessary.

12.5 If prices change between your order and Our processing of that order, the price valid at the time of ordering shall apply.

13. Orders and Provision of Services

13.1 No part of this Website constitutes a contractual offer capable of acceptance. Your order constitutes a contractual offer that We may accept at Our sole discretion. Acceptance is indicated by an order-confirmation email. Only once the order-confirmation email has been sent is there a binding contract between Salon AS and you.

13.2 Order-confirmation emails shall contain:

  13.2.1 confirmation of the Services ordered and their main characteristics;
  13.2.2 fully-itemised pricing including taxes, delivery and other charges;
  13.2.3 the applicable times and dates for the provision of the Services;
  13.2.4 login credentials and relevant information for accessing the Services.

13.3 If We do not accept your order, no payment shall be taken. Any sums paid will be refunded within 14 calendar days.

13.4 Payment shall be taken via your chosen method immediately for any set-up fees and on the same day of each month (“billing period”) for fees accrued during the previous period, and/or as indicated in the order-confirmation.

13.5 We aim to fulfil your order within 2 – 3 business days or within a reasonable period. If this is not possible, We will inform you. Time is not of the essence of the Contract. If you request Services to begin within 14 calendar days of acceptance, you must expressly acknowledge that your statutory cancellation right (Clause 14) will be affected.

13.6 Salon AS will provide the Services with reasonable skill and care in line with best industry practice.

13.7 If Services do not match your order (incorrect Services) you should inform Us immediately. Necessary corrections will be made within 5 business days. Additional terms may apply to certain Services; you will be asked to accept such terms when ordering.

13.8 Salon AS provides technical support via an online interface and/or telephone. We strive to respond swiftly but do not guarantee a specific response time.

14. Cancellation of Orders and Services

We want you to be completely satisfied with the products or Services you order from Salon AS. To speak to us about your Order, email support@herbwoman.eu/de or write to us at our address (see Clause 1). You may cancel an accepted Order or the Contract. Where Specific Terms accompanying the Service contain cancellation terms, those terms apply.

14.1 Cooling-off period (EU consumers)
If you are an EU consumer you have a statutory 14-calendar-day cooling-off period starting when your order is confirmed. To cancel within this period, email support@herbwoman.eu/de.

14.2 Services starting within the cooling-off period
  14.2.1 If the Services are fully performed within the 14-day period, you lose the right to cancel once provision is complete.
  14.2.2 If you cancel after provision has begun but before completion, you must pay for Services supplied up to cancellation. Refunds (where applicable) will be issued within 5 working days and no later than 14 calendar days.

14.3 Cancellation after the 14-day period is subject to the specific terms of the Service and may involve a minimum contract term.

15. Privacy

Use of the Website is also governed by Our Privacy Policy, incorporated by reference. We use Microsoft Clarity to analyse Website use; by using the site you consent to this data collection.

16. How We Use Your Personal Information (Data Protection)

16.1 All personal data We collect is handled in accordance with the UK Data Protection Act 1998 and your rights under that Act.

16.2 We may use your personal information to:

  16.2.1 provide Our Services to you;
  16.2.2 process your payment;
  16.2.3 inform you about new products and services (you may opt out at any time).

16.3 With your consent, We may share your data with credit-reference agencies if you wish to purchase Services on credit. These agencies are bound by the Data Protection Act 1998.

16.4 We will not share your data with other third parties without your express consent.

17. Disclaimers

17.1 We make no warranty that the Website will meet your requirements, be of satisfactory quality, fit for a particular purpose, non-infringing, compatible, secure or accurate. We do not guarantee specific results from use of Our Services.

17.2 No part of this Website constitutes advice and should not be relied upon when making decisions or taking action.

17.3 No part of this Website constitutes a contractual offer capable of acceptance.

17.4 While We endeavour to keep the Website secure and free of errors/viruses, you are responsible for your own internet security.

18. Changes to Facilities and Terms

We may change the Website, its Content or these Terms at any time. You are bound by any changes from your first use of the Website after the changes. If the law requires changes, they apply automatically to current and future orders.

19. Availability of the Website

19.1 The Website is provided “as is” and “as available”. Salon AS uses industry best practice for high uptime but gives no warranty of uninterrupted service and provides no refunds for interruptions.

19.2 We accept no liability for disruptions caused by external factors (ISP failure, power outage, natural events, war, legal restrictions, etc.).

20. Limitation of Liability

20.1 To the fullest extent permitted by law, We accept no liability for any direct or indirect loss or damage (including consequential or exemplary damages) arising from use of the Website or its information. Use the Website at your own risk.

20.2 Nothing in these Terms limits or excludes Salon AS’s liability for death or personal injury due to negligence or fraud.

20.3 Nothing in these Terms limits or excludes Salon AS’s liability for losses arising from incorrect provision of Services or reliance on incorrect Website information.

20.4 If any term is found unlawful, invalid or unenforceable, that term is deemed severed and does not affect the validity of the remaining Terms.

21. No Waiver

Failure by any party to exercise a right or remedy shall not be deemed a waiver of that right or remedy.

22. Previous Terms and Conditions

In the event of conflict between these Terms and any prior version, these Terms prevail unless expressly stated otherwise.

23. Third-Party Rights

Nothing in these Terms confers any rights on any third party. The agreement is between you and Salon AS.

24. Communications

24.1 Notices to Us must be sent by post (see address above) or email (support@herbwoman.eu/de). Notices are deemed received three days after posting (first-class), on the same day if the email is received on a business day, or the next business day if sent on a weekend or public holiday.

24.2 We may send you information about Our products/services if you opt in. To stop receiving such information, click “Unsubscribe” in any of Our emails.

25. Law and Jurisdiction

These Terms and Conditions and the relationship between you and Salon AS are governed by Norwegian law, and both parties submit to the exclusive jurisdiction of Norway.
